Wrongful Death
Legally, a wrongful death is a death that has been caused by the fault of another person. For example, deaths caused by auto accidents, semi-truck collisions, the manufacture of a defective or dangerous product, the construction of an unsound structure or building, or failing to diagnose a fatal disease may be considered a wrongful death.

Wrongful death lawsuits or claims are generally filed by family members or beneficiaries of the deceased.. In some instances, these claims are filed in order to obtain monetary damages to cover the earnings of the deceased. Other damages that may be recovered include:

  • Expense associated with the death, e.g., medical and funeral.
  • Lost benefits, such as insurance, from the death
  • Loss of inheritance from an untimely death
  • Pain, suffering or mental anguish suffered by the survivor of the decedent
  • Loss of companionship, care or protection
  • Punitive damages, intended to punish wrongdoers and prevent them from harming others

INSURANCE COMPANIES: When a loved one dies because of someone else’s negligence that claim will be handled through the responsible individual’s insurance company. Their insurance company’s agents are experts at handling this type of claim. It is their job to look out for the best interests of their company and their insured. You need an expert to represent your best interests.

INVESTIGATION: In all cases, but espeically in wrongful death cases, it is very important to have someone investigate the facts immediately after the occurrence. Evidence may be lost or damaged and witnesses may forget or move away. As a result, this may hurt your case. When our attorneys are hired, we immediately start to investigate the facts of your case.

FILING DEADLINES: There are statutory or contractual time limits for filing certain claims. If you fail to file your claim or notify the proper party within the appropriate time limit, you may lose your rights under the law which may affect your compensation for your claim.

WHAT WE DO: Our firm understands that after experiencing such trauma, your immediate goals are to:

  • Have someone investigate the case and preserve any necessary evidence and testimony;
  • Make sure all medical treatment and bills will be covered;
  • Make certain that statutory and contractual notices have been timely filed; and
  • Ensure that the insurance company fairly compensates you for the loss of your loved one, including any pain and suffering that occurred before the death.
